PC Upgrade - Data Recovery Terms & Conditions (updated May 2024)
Definitions:
“We/us/our” - PC Upgrade is a trading name of LeaseCapital/PC Upgrade - R Jackson T/A. PC Upgrade is a privately-owned IT equipment retailer and IT services business established and trading since March 1999 from our office/workshop in Keysoe. North Bedfordshire.
“Data Device”
Any device which holds digital or digitised data, commonly:
• Internal Disk Drives
• External USB disk drives
• Sata SSD Drives
• M.2 SSD Drives
• RAID Arrays
• USB Memory Stick drives
• Camera Media Cards
”3rd-Party Data Recovery Service”

Tampered Device Surcharge

If you have already “had a crack at it yourself” or “have a friend who knows what to do” and the drive has been tampered with or the device casing opened, this makes our chances of success much smaller. Please don’t open the device or give it to a friend to have a try, inexperience could damage your data beyond repair in this way. The tampered drive charge is non-refundable in any event.

Delivery & Collection

We may, by prior arrangement, send a DPD courier to collect your faulty data device and there is a £19 charge for this insured collection. If data recovery is successful and you agree to pay for your data recovery then there is a £10 charge for the re-delivery service within the mainland UK (there may be a small additional charge for the Highlands and NI). You may of course drop your data device in to us at your own expense if you live locally.
In the event of unsuccessful recovery or non-recovery of data or if you decide that data recovery would not be financially viable then the courier service is still chargeable. If you decide not to proceed we can securely destroy your device and provide a certificate of destruction. In this case, there would be no return carriage charge.
Liability limitation
PC Upgrade does not exclude or limit in any way any liability that cannot be restricted or excluded as a matter of law, and these Terms and Conditions are to be interpreted accordingly. If PC Upgrade fails to take reasonable care in providing the Data Recovery Services, PC Upgrade will use reasonable endeavours to correct its performance and repair any damage caused at no additional cost to the Customer. Alternatively, if it is not possible for PC Upgrade to correct its performance, the Customer will be entitled to an appropriate reduction in the price payable for the Data Recovery Services. If any recovered data is furnished by PC Upgrade to the Customer on a durable medium as part of the Data Recovery Services, such durable medium will be of satisfactory quality and reasonably fit for the purpose for which PC Upgrade has provided such durable medium to the Customer, for a reasonable period following delivery of such durable medium to the Customer. If such durable medium does not conform to the standards set out in this section, PC Upgrade’s sole liability, and the Customer’s sole remedy, in respect of such non-conforming good is repair or replacement of the relevant durable medium at the sole cost of PC Upgrade. However, it is the responsibility of the Customer to maintain a backup copy of any recovered data at all times.
UNDER NO CIRCUMSTANCES WILL PC UPGRADE ACCEPT ANY LIABILITY FOR ANY OF THE FOLLOWING WHATEVER THE CAUSE, SUBJECT TO TAKING REASONABLE SKILL AND CARE:
LOSS OF OR DAMAGE TO DATA
LOSS OF PROFITS, SALES, BUSINESS, OR REVENUES
ANY INDIRECT OR CONSEQUENTIAL LOSS, COST, OR EXPENSE OF ANY NATURE WHATSOEVER
PC Upgrade’s total liability (in contract, negligence, or otherwise) to Customer in connection with any Data Recovery Services shall in no event exceed the total sums payable under the relevant engagement by Customer to PC Upgrade. Where Customer instructs its own shipping company for shipping of any Customer media to PC Upgrade, then PC Upgrade shall not assume any liability whatsoever in case the device/media suffers any damage and/or loss during shipping. PC Upgrade recommends that the Customer takes out insurance to cover any risks.
Nothing in these terms and conditions shall affect your statutory rights.
Future changes
From time to time we may amend our terms and conditions to reflect any changes in company procedure or governing law. You accept now, by reading these terms that you are responsible for keeping up to date with any future changes. We will update our website to notify you of any amendments.
Governing law
Everything we do is governed by English Law and any matters relating will be dealt with under English Law and the Courts of England shall have exclusive jurisdiction. It is the client’s responsibility to comply with the laws of their home country. If in any doubt, clients must check that they would not be acting unlawfully by submitting anything to us for recovery. We shall not be liable in any way for unlawful data. The client agrees that any information provided is accurate, current, and true. This will be in accordance with the laws of England.
